Important: GiveNest is a for-profit company, not a charity or nonprofit. Contributions made through GiveNest are not tax-deductible. By using this platform, you agree to these terms in full.

1. Acceptance of terms

By creating an account or using any part of the GiveNest platform (hellogivenest.com), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use GiveNest. We may update these terms at any time. Continued use after changes constitutes acceptance.

2. What GiveNest is

GiveNest is a platform that connects verified single-parent families with donors who want to fund specific, essential needs. When a need is funded, GiveNest pays the named provider (e.g., daycare, grocery store, pharmacy) directly — no cash is ever given to families.

GiveNest is a for-profit LLC. A platform fee is collected on each donation to cover operating costs, fraud prevention, identity verification, payment processing, and platform development. The fee percentage is disclosed at checkout before any donation is confirmed.

3. Eligibility

You must be at least 18 years old to create an account or make a donation. By using GiveNest, you represent that you are 18 or older and have the legal capacity to enter into these terms. GiveNest is currently available to users in the United States only.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, complete, and current information when registering.

GiveNest reserves the right to suspend or terminate accounts that violate these terms, submit fraudulent or misleading information, or engage in any activity that harms other users, providers, or the integrity of the platform.

5. For parents — submitting a need

  • You must be the parent or legal guardian of the child(ren) associated with your need.
  • All information submitted — including your story, need description, goal amount, and provider details — must be truthful and accurate.
  • You must complete identity verification before your need can be approved and made public.
  • GiveNest reserves the right to approve, reject, or remove any need at its sole discretion, including for incomplete information, suspected fraud, or content that violates these terms.
  • Approved needs are visible to the public. By submitting a need, you consent to your family’s first name, story, category, and any uploaded photos being displayed publicly on the platform.
  • There are no fees to submit or post a need. GiveNest’s platform fee is collected from donors, not families.
  • Once a need is funded, GiveNest will pay the named provider on your behalf. You are responsible for ensuring the provider information you submit is accurate and that the provider is willing to accept payment from GiveNest.

6. For donors — making a contribution

  • All donations are voluntary and final. We do not offer refunds except in cases of technical error or verified fraud.
  • Contributions are not tax-deductible. GiveNest is a for-profit company and your donation is not a charitable gift.
  • A platform fee (disclosed at checkout) is deducted from each donation. The remainder goes toward fulfilling the family’s need.
  • GiveNest makes reasonable efforts to verify family needs but does not guarantee the accuracy of information submitted by families. Donations are made at your own discretion.
  • Once a need is fully funded, any additional contributions beyond the goal amount may be applied toward provider-related costs such as shipping, service fees, or overages.
  • GiveNest reserves the right to redirect excess funds toward the family’s other active needs or hold them in trust until a suitable need is identified.

7. Tips

At checkout, donors are given the option to add a tip to support GiveNest’s operations. Tips are voluntary and separate from the platform fee. Tips go entirely to GiveNest LLC to fund ongoing development, staffing, and growth.

8. Prohibited conduct

You agree not to:

  • Submit false, misleading, or fraudulent need listings.
  • Impersonate another person or misrepresent your identity or affiliation.
  • Use GiveNest for any unlawful purpose or in violation of applicable laws.
  • Attempt to circumvent, disable, or interfere with the platform’s security or functionality.
  • Scrape, harvest, or collect user data without our express written consent.
  • Use the platform to harass, threaten, or harm other users.
  • Post content that is defamatory, obscene, or infringes on any third party’s intellectual property.

9. Identity verification

GiveNest uses third-party identity verification services (Stripe Identity) to verify the identity of parents who apply for support. By completing verification, you consent to the collection and processing of your government-issued ID and related biometric or document data by Stripe pursuant to their Terms of Service. GiveNest does not store raw identity documents.

10. Payments and processing

All payment processing is handled by Stripe, Inc. By making a donation, you agree to Stripe’s Terms of Service. GiveNest does not store credit card numbers or full payment details. Stripe is a PCI-DSS compliant processor.

11. Intellectual property

All content on GiveNest — including the logo, design, copy, and platform code — is owned by GiveNest LLC and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from GiveNest’s content without written permission.

By submitting content to GiveNest (such as a need listing, story, or photo), you grant GiveNest a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content on the platform and in promotional materials related to GiveNest’s mission.

12. Disclaimers

GiveNest is provided “as is” and “as available” without warranty of any kind. We do not guarantee that the platform will be uninterrupted, error-free, or that any need will be fully funded. We make reasonable efforts to verify family needs but cannot guarantee the accuracy of all submitted information. Your use of the platform is at your own risk.

13. Limitation of liability

To the fullest extent permitted by law, GiveNest LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of funds, loss of data, or harm resulting from fraudulent need submissions. GiveNest’s total liability to you for any claim shall not exceed the total amount of platform fees paid by you in the 12 months preceding the claim.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or your use of GiveNest shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Termination

GiveNest may suspend or terminate your account at any time for violation of these terms, suspected fraud, or for any reason at our sole discretion. You may delete your account at any time by contacting us. Termination does not entitle you to a refund of any donations made.
